This right to extend the restrictions is mentioned in the Treaty of Accession of Romania to the EU and it was used by Austria, Belgium, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Italy, Lithuania, Poland, Spain and United Kingdom. With the exception of Germany, the member states listed above have made use of their right without informing Bucharest, so the officials in the Ministry of Transports and Infrastructure were left in the dark.

Unfortunately, uncertainties related to the possibility of carrying out cabotage operations still exist, this time related to Regulation (EC) 1072/2009 on access to international road transport market. Among other things, the regulation establishes new rules on cabotage, which should enter into force within three months, on May 14th. Under these rules, any company licensed for road transport in a EU member state may carry out cabotage operations, under certain conditions, in any other member state.

It is possible that this provision will not apply to Romanian hauliers, since the restrictions on cabotage agreed before 2007 have just been extended, before the entry into effect of Regulation (EC) 1072/2009.
