Taking into account the seasonal downturn for transport services, at least in the first quarter of 2010 insolvency, bankruptcy, and all kinds of acute problems will continue to be real threats. In such conditions, for companies that have sacrificed their financial results for 2009 in order to keep intact their workforce, collective layoffs still represent a final solution in the struggle for survival. This final solution is not an easy task however: under Romanian law, personnel layoffs may seem painfully slow.
”When a company goes through a reorganization process, the steps needed to let go some of the employees takes between one and three months to complete. It is a more expedite matter only in smaller companies, where the process may last two weeks to one month,“ says Alina Negrea, senior partner at A Plus Performance, a human resources company in Bucharest. Any company has to act cautiously not to break any law, since most of the time a judge would rule in favor of the employee if he or she is taking the employer to court.
